Terms of Service

1. Agreement to Terms

By accessing or using KinFolio ("Service") at kinfolio.pet, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. KinFolio is an AI-native workspace for dog breeders to manage health testing, litters, compliance, and buyer records.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. By using KinFolio, you represent that you meet these requirements and that the information you provide is accurate and complete.

3. Account and Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us immediately of any unauthorized use. We are not liable for any loss or damage arising from your failure to protect your account.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You will not:

• Violate any applicable law or regulation
• Infringe the intellectual property or privacy rights of others
• Upload malicious code, spam, or content that harms the Service or other users
• Attempt to gain unauthorized access to the Service, other accounts, or our systems
• Use the Service to misrepresent your breeding practices or falsify health or compliance records

We may suspend or terminate your access if we reasonably believe you have violated these terms.

5. Your Content and Data

You retain ownership of the data and content you upload to KinFolio ("Your Content"). By using the Service, you grant us a limited license to use, store, process, and display Your Content as necessary to provide and improve the Service (including AI-powered features such as M.I.L.O. alerts and suggestions). We do not claim ownership of Your Content. Our use of Your Content is subject to our Privacy Policy.

6. Service Availability and Modifications

We strive to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where practicable. We may update these Terms from time to time; continued use after changes constitutes acceptance. Material changes will be indicated by an updated "Last Updated" date.

7. Subscription and Payment

If you subscribe to a paid plan, you agree to pay all fees according to the plan you select. Fees are non-refundable except as required by law or as stated in our refund policy. We may change pricing with advance notice. Failure to pay may result in suspension or termination of your account.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED. KINFOLIO IS A TOOL TO SUPPORT YOUR RECORDKEEPING AND DECISIONS; YOU REMAIN RESPONSIBLE FOR COMPLIANCE WITH LAWS, REGISTRY RULES (E.G., AKC, USDA), AND YOUR OWN BREEDING PRACTICES.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KINFOLIO AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRIOR TO THE CLAIM (OR ONE HUNDRED U.S. DOLLARS IF GREATER).

10. Indemnification

You agree to indemnify and hold harmless KinFolio and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms or any law.

11. Termination

You may close your account at any time. We may suspend or terminate your access for violation of these Terms, non-payment, or for any other reason with notice where practicable. Upon termination, your right to use the Service ceases. We may retain your data as described in our Privacy Policy (e.g., for legal or compliance purposes).

12. General

These Terms constitute the entire agreement between you and KinFolio regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of the State of California, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in San Diego County, California.
